  • Zoning Exhibits Explained

    When a single owner or multiple owners of a piece of property apply to construct a new building or enlarge an existing building, all supporting documents must be submitted to the NYC Department of Buildings (DOB). This includes filing the correct Zoning Exhibits with the City Register or County Clerk’s office and obtaining a CRFN (City Register File Number). The CRFN is required before submitting the application and supporting documents to the DOB for review.

    These are the five types of Zoning Exhibits:
  • Exhibit I: Certification of Zoning Lot for Single Ownership

    For property that is in single ownership. The Zoning Resolution requires that a title company licensed to do business in NY State certify the parties having interest in the zoning lot.

    Must be filed in conjunction with Exhibit III.
  • Exhibit II: Certification of Zoning Lot for Multiple Ownership

    For property that is in multiple ownership. This is treated as one zoning lot with a Declaration of Restrictions that may be written individually or collectively with regard all interested parties. The Zoning Resolution requires that a title company licensed to do business in NY State certify the parties having interest in the zoning lot.

    Must be filed in conjunction with Zoning Lot Certification (Exhibits) III and IV.
  • Exhibit III: Ownership Statement

    For property that is in multiple ownership. This is treated as one zoning lot with a Declaration of Restrictions that may be written individually or collectively with regard all interested parties. The Zoning Resolution requires that a title company licensed to do business in NY State certify the parties having interest in the zoning lot.

    Must be filed in conjunction with Zoning Lot Certification (Exhibits) III and IV.
  • Exhibit IV: Zoning Lot Certification

    Select for any job requiring a Zoning Lot Certification Exhibit II (Multiple Ownership).

    The Zoning Resolution requires all parties in interest listed in Exhibit II must sign Exhibit IV or V and have executed and recorded the declaration or waived their respective rights.
  • Exhibit V: Zoning Lot Certification Waiver of Interest

    Select for any job requiring a Zoning Lot Certification Exhibit II, if any parties listed in Exhibit II are waiving interest.
    The Zoning Resolution requires that each party in interest has executed and recorded the declaration or waived their respective rights.
    To recap:
    Zoning Exhibits I and II require certification from a licensed title company.
    Zoning Exhibits III, IV, and V must be filed with City Register or County Clerk’s office, where a City Register File Number, or CRFN, will be obtained. This functions as a page or reel number, and is required for documents submitted to the DOB. A properly qualified title company can easily assist with these tasks.
    Once the procedures are completed, and everything filed properly, the DOB will receive all supporting documents and consider the application for approval.
